9.12.010 - Purpose and intent.¶
It is the purpose and intent of this chapter to conform Laws relating to gaming clubs within the City to the provisions of California Business and Profession Code Section 19819 and 19819.5(a) which read as follows:
- No gaming club Shall be located within the territorial limits of any County, City or City and County which had not Permitted gaming clubs prior to January 1, 1984 unless a majority of electors voting thereon affirmatively Approved a measure Permitting legal gambling with that City, County or City and County.

19819.5(a). On or after January 1, 1996, neither the governing Board nor the Electors of a County, City, or City and County that has not authorized legal gaming within its boundaries prior to January 1, 1996 Shall authorize legal gaming.
The City Council finds and determines that to Permit the Establishment and operation of gaming clubs in the City would be contrary to the public health, safety and welfare of the Residents of the City.

9.12.020 - Applications prohibited.¶
No Application to establish or operate a gaming club in the City Shall be accepted or processed unless and until the electors of the City affirmatively propose and approve an initiative measure in accord with California Law Permitting legal gambling within the City.

9.12.030 - City Council prohibited from proposing ballot measure.¶
No ballot measure addressing the issue of legal gambling Shall be proposed by the City Council. In the event such a ballot measure is Approved through the initiative process, any Application Fee for a license to operate a gaming club in the City Shall include such sum of money as is necessary to reimburse the City for all costs and expenses incurred by the City with respect to such ballot measure, as determined by the City Clerk.

9.12.040 - Games prohibited.¶
All games played with cards, dice, or other instrument, thing, device or machine for money, chips, credit, or any other article exchangeable for or redeemable in money, which games are not prohibited by any Law of the State of California are unlawful within the City.

9.12.050 - Penalty for Violations.¶
Any Person, or Persons, violating any provisions of this chapter is guilty of a misdemeanor and upon conviction thereof Shall be punished by a fine not exceeding three hundred dollars, or by imprisonment not exceeding three Months, or by both such fine and imprisonment.
