§ 2.2.1101. Appointment of the City Clerk.

The City Clerk shall be appointed by the City Manager, with ratification of such appointment by the City Council solely on the basis of administrative qualifications and shall hold office at the pleasure of the City Manager. The City Manager has the sole power to discipline, dismiss, or take any employment action with regard to the City Clerk that is authorized by this Code, applicable personnel rules and procedures of the City, or applicable law. Neither the City Manager nor any member of the Council may be appointed as City Clerk. Nothing in this section shall be construed to limit the authority of the City Manager over department heads and over employees appointed by or under the authority of the City Manager as provided in this chapter.

§ 2.2.1102. Powers and duties.

The City Clerk shall have all the power and duties as provided in this Code, the job description, and by the laws of the State of California unless authority is delegated to other employees by this Code. The City Clerk’s statutory duties related to financial and accounting tasks, including those codified in California Government Code Sections 37200 et seq., 40802 through 40805, or any subsequently approved codes authorizing financial or accounting duties of a city clerk, are transferred to the Director of Finance as authorized by Government Code Section 40805.5. The City Clerk shall work under the supervision and direction of the City Manager, or designee, for the efficient administration of the Office of City Clerk.
