16.10.010 - Action Before Filing.

A tentative parcel map and a parcel map will be filed and processed for all subdivisions for which a final map is not required. The procedure to be followed in filing and gaining approval of a tentative parcel map and a parcel map for a subdivision is generally as outlined in Chapter 16.08, as modified by this chapter.

16.10.020 - Preparation of Parcel Map.

The final parcel map shall be developed in three (3) phases, as follows:

A.

Pre-filing conference. Subdivider may submit a preliminary parcel map for city staff review to assist in preparation of the tentative parcel map.

B.

Tentative Parcel Map. The fully formatted tentative parcel map shall be submitted for city staff and Planning Commission review and recommendations.

C.

Parcel Map. The parcel map as approved by the Planning Commission and recorded.

16.10.030 - Dedications.

Dedications or offers of dedication as required may be made either by certificate on the parcel map or be a separate instrument, as provided by conditions of approval. If dedications or offers of dedication are made by separate instrument, such dedications or offers of dedication shall be recorded concurrently with, or prior to, the parcel map being filed for record. Such dedication or offers of dedication, whether by certificate or separate instrument, shall be signed by the same parties and in the same manner as set forth for dedication by a final map.

16.10.040 - Certificate.

The following certificates shall appear on a parcel map:

A.

Certificate of consent;

B.

Engineer's certificate;

C.

Certificate of dedication, if required;

D.

Certificate of soils report;

E.

City engineer's certificate;

F.

City clerk's certificate, if required;

G.

County recorder's certificate.

16.10.050 - Action by the Planning Commission.

The Planning Commission shall hear the tentative parcel map within fifty (50) days after it being deemed complete by the Community Development Director, and shall render a decision within thirty (30) days unless an extension is consented to by the subdivider.

If the subdivision is denied, the subdivider shall be so notified in writing with a statement for the reasons of denial.

16.10.051 - Approval or Denial.

In approving or conditionally approving the tentative parcel map, the Planning Commission shall find that the proposed subdivision, together with its provisions for its design and improvements, is consistent with applicable general or specific plans adopted by the City and conforms to the applicable zoning regulations.

The tentative parcel map may be denied by the Planning Commission on any of the ground provided by city ordinance or the Map Act. The Planning Commission shall deny approval of the tentative parcel map if it makes any of the findings contained in Section 66474 of the Government Code.

16.10.052 - Conditions of Approval.

In approving the tentative parcel map, the Planning Commission may impose as conditions of filing a parcel map any or all but not limited to the following requirements:

A.

Frontage improvements;

B.

On-site improvements;

C.

Off site improvements;

D.

Dedications;

E.

Applicable fees;

F.

A soils and/or engineering geology report.

These requirements shall be in accordance with the provisions of this chapter. The subdivider shall be notified in writing of all the conditions imposed.

16.10.053 - Appeals of Planning Commission Action.

Appeals shall be processed in accordance with the requirements of Section 16.08.028 of this title.

16.10.054 - Expiration and Extensions.

A.

Expiration. The approval or conditional approval of the tentative parcel map shall expire twenty-four (24) months from the date of approval. The expiration of the approved or conditionally approved tentative parcel map shall terminate all proceedings and no parcel map of all or any portion of the real property included within such tentative parcel map shall be filed without first processing a new tentative parcel map.

B.

Extensions.

The period of time specified in subdivision A of this section may be extended in accordance with and for the reasons stated in Sections 16.08.029.B. and C. of this title.

16.10.060 - Filing Maps with County Recorder.

After approval of the parcel map by the City Council, the city clerk shall transmit the map directly to the county recorder.

16.10.070 - Correction and Amendment of Map.

After a parcel map is filed in the office of the county recorder, it may be amended by a certificate of correction or an amending map in accordance with Section 66469 through 66472 of the Government Code.
