10.60.010 - Definitions.¶
The words and terms used in this chapter have the following meanings:
"Curfew hours" means the period of time commencing at ten p.m. on each day of the week, including Friday and Saturday, and terminating at six a.m. of the next following day.
"Emergency" means an unforeseen combination of circumstances or the resulting state that calls for immediate action. Emergency includes, but is not limited to, a fire, a natural disaster, automobile accident, or any situation requiring immediate action to prevent serious bodily injury, loss of life or property damage.
"Emancipated" means a minor who has been judicially emancipated or a minor who has graduated from high school.
"Guardian" means a person or public or private agency who, under court order, is designated as the guardian of the person of a minor.
"Minor" means a natural person under eighteen years of age.
"Parent" means a person who is a natural parent, adoptive parent, or step-parent of a minor.
"Public place" means any place to which the public or a substantial group of the public is invited, or has access; public place includes, but is not limited to, public streets and the common public areas of schools, hospitals, apartment houses, office buildings, transport facilities and shops.
"Remain" means to:
Linger or stay at or in a public place; or
Fail to leave a public place when requested to do so by a police officer.

10.60.020 - Offenses.¶
A. A minor who violates any provision of this chapter by remaining in a public place during curfew hours is guilty of an infraction; subsequent violations by the same minor occurring within ninety consecutive calendar days are punishable as misdemeanors.
B. A parent or guardian of a minor is guilty of a misdemeanor if he or she knowingly permits, or by failing to exercise sufficient control over the minor, allows the minor to violate any provision of this chapter.

10.60.030 - Defenses—Curfew hour violation.¶
It is a complete defense to a prosecution of a minor for a violation of the curfew hour provisions of this chapter, if the minor was, at the time of the charged violation:
A. Accompanied by the minor's parent or guardian; or
B. Directly engaged in an errand at the express direction of the minor's parent or guardian; or
C. In a motor vehicle which is engaged in intrastate or interstate travel; or
D. Engaged in an employment activity, or going directly to or directly returning home from an employment activity; or
E. Involved in an emergency; or
F. On the sidewalk abutting the minor's residence; or
G. Attending a school activity or religious activity sponsored by a school or religious group/church or a recreational activity sponsored by a public entity or a private sponsoring entity which provides adult supervision of the activity; or while going to or returning home from, without any detour or stop, such an activity; or
H. Lawfully exercising constitutional rights such as the free exercise of religion, freedom of speech, or the right of assembly; or
I. Emancipated.

10.60.040 - Penalties.¶
A person who violates any provision of this chapter is guilty of a separate violation for each day or part of a day during which the violation is committed, continued, or permitted.
