AB 1950 PETITION REFERENCE

Petition filed by Probation 1. Probation reviews appropriate cases and files a petition with the Court, setting a hearing date out a minimum of 25 days with the Court. District Attorney will work with Probation to select an appropriate number of cases to be filed per week to allow the District Attorney’s Office time to review. 2. Probation sends a copy of the Petition to Defendant, District Attorney’s Office, and Public Defender or last known attorney. 3. District Attorney’s Office reviews Petition and files a Response and Order with the Court, completing the appropriate boxes (Concur or Object). a. If District Attorney Concurs with Probation the Petition will be sent to the Duty Judge for signature and entry of Order b. If District Attorney Objects the matter will remain on calendar on the date listed on the Petition. c. If the District Attorney does not respond the matter will remain on calendar on the date listed on Petition. 4. A copy of the Response and Order will be provided to the District Attorney, Probation, and Defendant/Counsel.

The Court may reject filing due to: 1. Duplicate filing 2. Previously granted 3. Incorrect or missing case number 4. No hearing date 5. Missing Proof of Service

The Court will not reject a filing due to: 1. Defendant signature missing or not an original signature 2. Court date selected is not 25 days out as long as it is more than 14 days

If court date selected is a weekend or holiday the matter will be set on the next business date.
