The Court having considered the upcoming amendments to the Federal Rules of
Bankruptcy Procedure scheduled for December 1, 2016, implements changes to the Local Bankruptcy Rules. Local Bankruptcy Rule 2002-2(d) is modified to delete the reference to electronic service regarding the three additional days allowed pursuant to FRBP 9006(f). Local Bankruptcy Rule 7012-2 is deleted since it is duplicative of amended FRBP 7012. The remaining LBR 7012 rules will be renumbered.
IT IS ORDERED that the Local Bankruptcy Rules are modified as indicated
below:
LBR 2002-2(d) Response. Except as provided in LBR 4002-2(d)(5) (requiring a 14-day response time), any opposition or response to a notice of intended action must be filed and served not more than 21 days after service of the notice of intended action, along with a request and notice for hearing substantially conforming to Local Form CSD 1184. If service of the notice of intended action and opportunity for hearing was by mail or through the System, FRBP 9006(f) applies.
LBR 7012-2. In addition to the statement required by FRBP 7012(b), the pleading must also contain a statement that the pleader does or does not consent to entry of final orders or judgment by the bankruptcy judge if any matters are determined to be core.
IT IS FURTHER ORDERED that the period for comment is from now until
November 30, 2016. Except as set forth in further order of this Court, the effective date of this order shall be December 1, 2016.
