INFORMATION ABOUT YOUR PROBATE INVESTIGATION INTERVIEW

You are required to participate in a Probate Investigation interview when seeking guardianship of a minor. The Probate Investigator will meet with you and the child/ren to gather information regarding the social history of the proposed guardians, the parents, and the child/ren. The investigation may include a joint and individual virtual interview with each proposed guardian and child/ren. Most interviews are completed within approximately one to two hours; however, the length may vary depending on your case. Upon completion of the interview, the investigator will prepare a report to the Court based on the information provided during the probate investigation, including details from the Probate Investigation Guardianship Information Sheet (SCLAC PROI 072), interviews, and additional information from collateral sources as deemed appropriate. Probate Investigation Interviews are conducted remotely using the Microsoft Teams application. All Microsoft Teams interviews should be conducted from a private, quiet location, preferably from your home residence. The minor child/ren must be present for the investigation interview. In some cases, the Court or Probate Investigations Office may determine that a follow-up interview must occur in person at the courthouse. In- person interviews are scheduled only when necessary and are not available by request. If you attend an in-person interview, a child waiting room is available at the court, although you may choose to bring a responsible adult with you to help care for the child/ren when the investigator interviews you privately. You are responsible for notifying the parents of this investigation interview. The parents do not have to attend unless they oppose the guardianship or wish to provide information in support of it. The following documents are required for the guardianship investigation. You may email the documents to PI@LACourt.ca.gov at least three (3) days prior to your scheduled interview, or you may mail copies of the documents at least ten (10) days before the interview to Probate Investigations, 111 N. Hill Street, Room 241, Los Angeles, CA 90012. 1. Birth certificates of the child/ren 2. Minor’s school records, last report cards, progress reports, Individualized Education Program (IEP), school enrollment forms, etc. 3. Minor’s medical records, immunization records, Medi-Cal cards. 4. Proposed guardian(s) proof of identification (e.g., driver's license, passport, etc). 5. Proposed guardian(s) list of medical conditions and prescription medications. 6. Proposed guardian(s)’s evidence of residence, such as mortgage statement, rental receipts, lease agreement or utility bills showing the proposed guardian(s) as the payer at the property stated to be home for the minor. 7. Parent’s death certificates, if deceased. 8. Names and personal information (e.g., Date of Birth) of persons residing in the proposed guardian(s)’ household. 9. Names and addresses of all individuals who require legal notice.
