In response to the requests of the bar because of increased requirements of the
Bankruptcy Abuse and Consumer Protection Act of 2005, the Bankruptcy Court has reviewed its guideline fees for attorneys filing Chapter 13 cases. This will be the second fee revision since BAPCPA went into effect.
The court conducted an extensive review of guideline fees adopted by the three other
California Bankruptcy Courts and select courts within and outside the Ninth Circuit; analyzed the results of the Chapter 13 Attorney Fee survey that was distributed to all Chapter 13 debtor’s attorneys filing cases since October 2005; and reviewed correspondence received by the United States Trustee regarding the fee guidelines.
Based upon the Court’s research, attorney fee survey responses, and other input received
to date, the Court is revising the Chapter 13 Attorney Fee Guidelines for both consumer and business cases.
IT IS ORDERED that the guideline fees are revised as follows:

All other fee amounts in the Chapter 13 Attorney Fee Guidelines remain at their current levels. The revised Chapter 13 Attorney Fee Guidelines and the Chapter 13 Rights and Responsibilities are posted on the Court’s website located at www.casb.uscourts.gov.
IT IS FURTHER ORDERED that the period of comment shall be now until JANUARY
7, 2008. The effective date of this amended rule will be JANUARY 14, 2008. Any comments should be submitted to the Clerk of Court at 325 West “F” Street, San Diego, California 92101- 6991. Please note on the envelope: “In re: 13 Guidelines.”
