CUSTODY MEDIATION
The parties agree to attend custody mediation via remote video-teleconferencing through Family Court Services to try to reach agreements about a custody or parenting issue without filing a motion with the Court. Each party must complete the Mediation Orientation Program before mediation will be scheduled. The Interactive Video Orientation is available at: http://www.scscourt.org/court_divisions/family/fcs/fcs_orientation.shtml. After both parties complete Orientation, Family Court Services will notify the parties with the mediation appointment date and time. If a party has experienced domestic violence and has concerns about participating in the mediation, that party should contact Family Court Services at (408) 534-5760 to discuss those concerns. If the parties reach agreement during mediation, Family Court Services will write out the agreement per the local family rules. If the parties do not reach agreement during mediation and either party still wants a Court Order, that party must file a motion with the Court. This Stipulation can be signed electronically or by fax. This Stipulation (signed by both parties) is to be filed with the clerk’s office and a copy provided to Family Court Services either by fax at (408) 534-5791, in person or by mail (street address and mailing address are at the top of this form).
