General Order 44 (July 25, 2023)

Explanatory Statement

The court adopted General Order 44 effective July 25, 2023. G.O. 44

essentially abrogates – in phases – most of the practices, procedures, and other general orders adopted by the court to manage the impact of the COVID-19 pandemic on its operations. Given the significance of some of these changes, and to provide as much clarity as possible, the court offers this explanatory statement regarding what G.O. 44 does and when.

8th Amended General Order 38

Paragraph 8: Permitted non-ECF filers to file documents using an electronic

document upload feature on the court’s website, in addition to filing via mail, designated drop-boxes, or at the Clerk’s Office Intake Counter. Effective immediately, the electronic document upload feature will no longer be available.

Remainder of 8th Amended G.O. 38: The rest of 8th Amended G.O. 38 will

be abrogated as of September 1, 2023. By that date, each judge will have posted to their page on the court’s website procedures for noticing and conducting hearings. The court expects parties to comply with the relevant judge’s procedures.

3d Amended General Order 39

3d Amended G.O. 39 temporarily suspended the court’s Electronic Case

Filing Procedures’ requirement that each e-filer possess the signatory’s original, physical, “wet” signature before filing a pleading or document. Effective immediately, the ECF Procedures’ wet signature requirement is reinstated.

2d Amended General Order 40

2d Amended G.O. 40 extended deadlines under Rules 1017(e), 4004(a),

4007(c), 4008(a), and 1007(c) of the Federal Rules of Bankruptcy Procedure in cases filed before May 1, 2020 and in which the meeting of creditors was initially scheduled on or after March 17, 2020. Effective immediately, these extended deadlines are abrogated.

3d Amended General Order 40

3d Amended G.O. 40 clarified that the extended deadlines implemented by

2d Amended G.O. 40 did not apply in individual cases converted under 11 U.S.C. §§ 706, 1112, 1208, or 1307 to a different chapter. Effective immediately, 3d Amended G.O. 40 is abrogated.

General Order 43

G.O. 43 adopted the court’s Policy Regarding COVID-19 Vaccination &

Testing. G.O. 43, as well as the court’s Policy Regarding COVID-19 Vaccination & Testing, are abrogated, effective immediately.

General Order 41

G.O. 41 provides for the filing of a Notice of Forbearance where a Chapter

13 debtor obtains loan forbearance relief under the Corona Virus Economic Stabilization Act of 2020 (the “CARES Act”). G.O. 41 will be abrogated as of December 1, 2023.
