In re: ) ) AMENDMENT OF LOCAL ) BANKRUPTCY GENERAL BANKRUPTCY RULE 3003-1 ) ORDER NO. 194-B _____________________________________ )

On January 28, 2020, the Court adopted an amendment to Local Bankruptcy Rule

3003-1, which modified the time for filing claims in Chapter 11 cases and set a time for filing claims in Subchapter V cases created as part of the Small Business Reorganization Act of 2019. Since adoption of this amendment, the court became aware of an inconsistency between the Local Bankruptcy Rule and the Bankruptcy Code regarding the bar date for filing government claims that should be accommodated. Accordingly:

IT IS ORDERED that Local Bankruptcy Rule 3003-1 is modified as follows:

RULE 3003. CLAIMS BAR DATE AND FILING PROOFS OF CLAIM IN CHAPTER 11 CASES

3003-1. Unless otherwise ordered by the Court, and except as provided in FRBP 3003(c)(3), proofs of claim or interest must be filed pursuant to FRBP 3003 and within 70 days after the date of the order for relief. If the claimant is a governmental unit, the proof of claim or interest must be filed within 180 days, or at such a later time as the Federal Rules of Bankruptcy Procedure or the Court may provide. For chapter 11 cases filed under Subchapter V, all claims – including by governmental units must be filed within 70 days after the date of the order for relief.

IT IS FURTHER ORDERED that the effective date for this change will be

March 18, 2020.
