Before the Court this day is the continued hearing on a petition to approve the final distribution plan, including the amounts sought for statutory fees and reimbursement. The Court previously not4ed a few concerns, which were discussed in detail with counsel and petitioner at the previous hearing. In advance of this hearing, it was expected that the petitioner would provide the following:

Some clear path forward on how the creditor claims would be referenced in the final petition. As noted, between 12/26/2024 and 01/13/2025 this Court received three creditor claims that were mailed to petitioner’s previous residence.

An assignment from the former spouse Kristen that she is foregoing her spare whether that be 50% or 33.33%. See Probate Code §6401(a).

As assignment from Kristen, Max and Brendon setting forth the reason they prefer to give a gift to petitioner knowing it may trigger IRS implications rather than simply disclaim their interest and allow an equal share of the estate to pass to the remaining three parties (petitioner, Taylor, Zakary) in equal shares). See Probate Code §11604(b).

At the time of review and preparation of this note, nothing has been filed.

This is the scheduled review hearing on the status of the ongoing administration, pursuant to Probate Code §12201. However, a review of the court file reveals a vacancy where the required §12200 petition or status report is supposed to be. While this Court can plainly see the Notice of Proposed Action to sell a parcel of real property filed six weeks ago, that is not a substitute for a report. In fact, this Court has a very fine, user-friendly status report form (TUO-PR-125) to make the process as easy as falling asleep at a Max Richter concern. Counsel to advise.

This is the continued hearing on a petition to approve the proposed estate distribution. At the previous hearing, this Court identified a few small issues, which counsel advised would be quickly addressed in a supplemental proposed order. However, at the time of review, no such order has arrived. The issues are as follows: Assuming an estate value of, there appears to have been a loss to the estate of the following assets: $1,500 (Subaru); $900 (Honda Shadow); $350 (1970 boat); $400 (1970 boat); $2,100 (1980 boat); and $7,000 (furnishings). Unless these assets were accounted for elsewhere, statutory fees must be reduced accordingly. Petitioner’s request for reimbursement from the distributable net of the estate cannot include the $1,190 he paid on 02/20/2024 for the probate attorney deposit since estate attorneys are only paid via statute and court order, not on retainer.

This is the continued initial hearing on a by-pass petition to determine intestate succession to decedent’s primary residence. Petitioner purports to be the successor in interest by virtue of §6402(a), in that he is the sole natural heir. At the prior hearing, this Court identified two shortcomings.

First, every by-pass petition must state “the facts upon which the petitioner bases the allegation that the described real property was the decedent's primary residence.” See §13152(a)(3). There was nothing in the petition connecting 22000 Elizabeth Lane to the

decedent, let alone as his primary residence. Although one’s “primary residence” can differ from one’s last residence (ie, assisted living, hospice), there must still be some permanency or continuing expectation of periodic return associated with the former. See, e.g., CCP §704.995; Govt. Code §244; Veh. Code §516; Estate of Wardani (2022) 82 Cal.App.5th 870, 882-883; Marriage of Amezquita & Archuleta (2002) 101 Cal.App.4th 1415, 1419-1420; Kibbee v. Blue Ridge Ins. Co. (1999) 69 Cal.App.4th 53, 61-62; DeMiglio v. Mashore (1992) 4 Cal.App.4th 1260, 1268.

Second, a trial court may grant a by-pass petition only if it determines “the property described in the order is property of the decedent.” See §13154(b)(4). There was nothing in the petition demonstrating decedent’s ownership of 22000 Elizabeth Lane, at any time and certainly not at this time when orders are being sought.

On 04/08/2026, petitioner filed a supplement to his petition which – to put it mildly – hit this one out of the park. The quality and quantity of evidence supplied by petitioner establishing current ownership and primary residence sets a new benchmark for this Court, and gives this Court much pleasure in granting the petition forthwith.

Petition for Instructions Minors Mental Health Treatment and Placement

01/28/2021 Petition File Tracking 01/28/2021 Petition 04/12/2024 High Density

On 04/07/2026, guardians filed a petition for instructions regarding their options to secure “behavioral health” treatment for the ward.

Notice: Absent good cause (§1203) or a request for emergency intervention, all
guardianship petitions for instruction require at least 15 days’ notice
(§1460(a)). As such, this petition cannot be heard this day. In addition,
guardianship petitions require notice to the ward (§1460(b)(2)), and there is
no proof of that having occurred. Finally, in light of the concerns raised at
the previous hearing regarding the possibility of resignation, notice must
also be provided to the biological parents (§1202).

Merits: While it is premature to address merits, §2403 pertains to estates only. It
is generally understood that guardians have the right to subject wards to
non-surgical medical treatment (§2353), but may not have the ward
sterilized, admitted to a mental health facility, or subjected to experimental
drugs/treatments without a specialized hearing. See §2356. For
nonconsensual mental health care that does not rise to the level of
involuntary institutionalism, a petition can be used but it must support with
specificity and medical affidavits showing (1) the nature of the medical
condition requiring treatment, (2) the recommended course, (3) the threat
to the health of the ward if authorization to consent is delayed or denied,
(4) the predictable or probable outcome of the recommended treatment, (5)
medically available alternatives, if any, and (6) the efforts made to obtain
an informed consent from the ward. See §2357(c). This petition
does not include any of the requirements.

Despite bio mom’s historical resistance to this guardianship, and eventual acquiescence, she has recently filed a petition to terminate this guardianship – and in conjunction with the guardian’s relocation do to his own “family instability” where he was living.

This case will require further involvement by the court investigator, and new involvement by minor’s counsel. Voir dire the parties regarding their ability to cover the related costs in lieu of county funding.

This is the annual review of an established guardianship. In the report, the guardian notes that the time has come to consider terminating the guardianship and allowing the child to return full-time to his biological mother. There is a complex background that will require involvement from the court investigator before the guardianship can be terminated.

Bio dad: Christopher Means – rights terminated (2018) Bio mom: Jalynne Castro – rights terminated (2018) Adopted: Angela Means – unable to care Guardian: Debra Sprague (2021)

In re Noreen G. (2010) 181 Cal.App.4th 1359, 1392-1394: “Absent an explicit agreement to the contrary, a birth parent is not entitled to postadoption visitation with his or her children … [however], agreements that provide for birth parents to continue visitation with their children following termination of parental rights or adoption are also recognized by statute and enforceable, but any such agreements must be in writing and must be found by the court to be in the best interests of the children. Fam.Code, § 8616.5”

§2662: “Whenever the court grants a petition removing the guardian or tendering the resignation of the guardian, if the court does not immediately appoint a successor guardian, the court shall at the same time appoint a responsible adult to make educational decisions for the minor until a successor guardian is appointed.”

Related to FL14605.

This guardianship was commenced via petition filed in 2016. According to the guardian: (1) bio mom was incarcerated; (2) bio dad was “absent” and homeless; and (3) child was with petitioner since birth.

On 01/09/2026, the guardian appeared at the annualized review hearing with the CG-251 in hand and advised that she had recently moved and apologized for missing the initial review hearing. She advised that she “did not know” her new address and would update the court as soon as she could. For reasons that are not clear, the GC-251 she handed the court that day was never scanned into the file.

On 01/26/2026, Brandi Flores – a great grandmother – filed a motion for visitation indicating a desire to take the child to see his father.

On 03/06/2026, both Brandi and Jesus, the ward’s biological father, appeared at the hearing on Brandi’s motion and informed this Court that the guardian is reportedly homeless and has apparently traveled to Oklahoma to “drop off” the ward with the biological father and flee. Father proceeded to file a motion to terminate the guardianship and a motion to determine parental relations.

Court shall call up FL14605 and enter an order immediately halting Father’s $33/month child support obligation owing to the guardian, and order updated FL-150s from both parties in order to establish an order favoring father.

This is an established general conservatorship over the person and estate of an elderly man, presently in the care of his daughter. The Court is awaiting receipt and review of the required annual investigative report. Since Probate Code §1851(b)(1) requires the report to be filed and served “not less than 15 days before the date of review,” the hearing may need to be continued unless the interested waive the notice defect.
