UNITED STATES BANKRUPTCY COURT SOUTHERN DISTRICT OF CALIFORNIA OR A CONTINUING RESOLUTION In re: ) ) OPERATING THE COURT IN THE ) BANKRUPTCY GENERAL ABSENCE OF AN APPROPRIATION ) ORDER NO. 208 ) ) In the absence of appropriations or a continuing resolution, and following the exhaustion of legally available sources of funding, the Court adopts the following plan to exercise its constitutional functions to hear and resolve cases and proceedings. All judges, their chambers staff, the Clerk, and employees of the Clerk’s Office will perform “excepted activities” as defined in the Antideficiency Act. The Court will reduce its operations and maintain minimum employee staffing to support those excepted activities and secure the Court’s resources and property. This support includes accepting new cases in person or through the electronic case filing system, including properly and promptly processing all filings, motions, orders, emergency applications, and other court documents. The Court will coordinate with the U.S. Marshals Service, the Federal Protective Service, and the General Services Administration to adequately protect the safety of human life and property.
