F SEP 16 2024 SUPERIOR COURT OF CALIFORNIA py COUNTY OF EL DORADO GENERAL ORDER RE: IMPLEMENTATION OF EMERGENCY RELIEF AUTHORIZED PURSUANT TO GOVERNMENT CODE SECTION 68115 BY CHAIR OF JUDICIAL COUNCIL Exercising the authority granted under Government Code section 68115 and the September 16, 2024, Order (“Order”) of Chief Justice Patricia Guerrero, Chair of the Judicial Council of California, issued in response to the request for an emergency order made by the Superior Court of El Dorado County (“Court”) on this same date, this Court HEREBY FINDS AND ORDERS AS FOLLOWS: L. For purposes of computing time under Penal Code section 825 and Welfare and Institutions Code sections 313, 315, 334, 631, 632, 637, and 657, September 16, 2024, to September 18, 2024, inclusive, are deemed holidays if the emergency conditions described in the Order prevent the court from conducting proceedings or accepting filings as necessary to satisfy these deadlines on those dates (Gov. Code, § 68115(a)(5)); 2. Any judge of the Court may extend by not more than 10 days the duration of any temporary restraining order that would otherwise expire from September 16, 2024, to September 18, 2024, inclusive, if the emergency condition prevented the court from conducting proceedings to determine whether a permanent order should be entered (Gov. Code, § 68115(a)(7)); 3. Any judge of the Court may extend the time period provided in section 859b of the Penal Code for the holding of a preliminary examination from 10 court days to not more than 15 court days, applicable only to cases in which the statutory deadline otherwise would expire from September 16, 2024, to September 18, 2024, inclusive (Gov. Code, § 68115(a)(9)); and 4. Any judge of the Court may extend the time period provided in section 1382 of the Penal Code for the holding of a criminal trial by not more than 15 days, applicable only to cases in which the statutory deadline otherwise would expire from September 16, 2024, to September 18, 2024, inclusive (Gov. THE JUDICIAL COUNCIL OF THE STATE OF CALIFORNIA Because of severe indoor flooding causing hazardous conditions in the South Lake Tahoe courthouse, it has been determined that the conditions described in section 68115 of the Government Code are met with regard to the Superior Court of California, County of El Dorado. Upon the request of Presiding Judge Vicki Ashworth, it is ordered that the Superior Court of El Dorado County is authorized to do the following: e Declare that from September 16, 2024, to September 18, 2024, inclusive, be deemed holidays for purposes of computing time under Penal Code section 825 and Welfare and Institutions Code sections 313, 315, 334, 631, 632, 637, and 657, if the above-described emergency conditions prevent the court from conducting proceedings or accepting filings as necessary to satisfy these deadlines on those dates (Gov. Code, § 68115(a)(5)); e Extend by not more than 10 days the duration of any temporary restraining order that would otherwise expire from September 16, 2024, to September 18, 2024, inclusive, because the emergency condition described herein prevented the court from conducting proceedings to determine whether a permanent order should be entered (Gov. Due to the indoor flooding and resulting damage, branch closure from September 16, 2024, to September 18, 2024, is ordered as follows:
- South Lake Tahoe Branch will be closed. It is further ordered:
- In-custody criminal arraignments normally heard in Department 3 of the South Lake Tahoe Branch will be heard on the Western Slope.
- Juvenile detention hearings normally heard in Department 4 of the South Lake Tahoe Branch will be heard on the Western Slope.
- All matters not heard as scheduled due the branch closure will be rescheduled and notice from the Court with a new hearing date and time will be issued for all continued matters.
