Ratliff, Coroner15 IT IS HEREBY STIPULATED AND AGREED by and between Dawn

16 Division Chief for the County of Kern, and Cynthia Zimmer, District Attorney for the County of Kern,

that:l7 counsel for the PEOPLE OF THE STATE OF CALIFORNIA,

l8 1. The Kern County Sheriff’s Office Coroner’s Division will produce an unredacted copy of

I9 the CorOner’s Case File to the Kern County District Attorney’s Office upon request

20 utilizing the attached Request Form (Exhibit A), subj ect to the limitations of this stipulated

21 order.

22 2. The parties agree that production of the Unredacted Coroner’s Case File will apply to filed

23 felony cases with a charge of PC 187 and or PC 192.

3. The Kern County District Attomey’s Office is permitted to provide a copy of the

   Unredacted Coroner’s Case File to the attorney of record for the defense in the criminal

   et seq. and Brady v. Maryland (1963) 373 U.S. 83. case pursuant to PC §§ 1054

   4. Cal. Civ. Code § 56.10(b)(8) and (c)(6) limit disclosure of medical information t0 third

   parties by a medical examiner, forensic pathologist, or county coroner in the course of an

   investigation without a court order or authorization pursuant to § 56. 1 1.

   a. This order provides the authorization required for the Kern County Sheriffs Office

   Coroner Division to release medical information to the Kern County District

   Attorney’s Office, pursuant to Civ. Code §§ 56.10(b)(8) and (c)(6).

10 5. Cal. Civ. Code § 56.11 authorizes release of medical information when specificity is

11 provided:

12 a. The medical information will be disclosed by the Kern County Sheriffs Office

13 Coroner’s Division. (Civ. Code, § 56.1 1(e) and (f).)

l4 b. The medical information will be received by the Kern County District Attorney’s

15 Office. (Civ. Code, § 5611(1).)

16 c. The type of medical information produced will be the medical information received

17 by the Kern County Sheriff’s Office Coroner’s Division related to the specific case.

18 (Civ. Code, § 56.11(d) and (g).)

l9 d. The medical information will be used t0 prove the felony violation of PC 187 and 0r

20 PC 192 in a court of law, and or any other related charge in the case. (Civ. Code, §

21 56.1 1(d).)

22 6. The orders provided for herein shall remain in effect until either the Kern County District

23 Attorney or County Counsel for the County of Kern files with this court written notice of

24 withdrawal of approval and proof of service upon the opposing party.
