The Calaveras Board of Supervisors directs that all fines, fees, and increased bail amounts as a result of Resolution No. 2013-072 shall be terminated effective May 1, 2022. The Calaveras County Superior Court hereby removes the increase in fines and fees implemented pursuant to Resolution 2013-072. See the attached Board of Supervisors Resolution No. 200203221029. BOARD OF SUPERVISORS, COUNTY OF CALAVERAS STATE OF CALIFORNIA March 22, 2022 Resolution RESOLUTION RESCINDING RESOLUTION 2013-072, No. 20220322r029 AND DIRECTING THAT THE CALAVERAS COUNTY SUPERIOR COURT BE NOTIFIED TO REMOVE THE INCREASE IN FINES AND FEES’ IMPLEMENTED PURSUANT TO RESOLUTION 2013-072, AND DONATING THE FINES AND FEES COLLECTED UNDER THE DUIRR PROGRAM, AND KEPT IN THE CALAVERAS COUNTY DESIGNATED DUIRR FUND (ACCT. NO. 55260000), TO THE CALAVERAS COMMUNITY FOUNDATION. REQUIRING 4/5 VOTE OF THE BOARD WHEREAS, driving under the influence of alcohol or drugs or prescribed medications is a violation of California Vehicle Code Sections 23152 and 21353 and results in a cost to the taxpayers of Calaveras County and leads to accidents involving injuries and fatalities, and; WHEREAS, the DUIRR Program was originally established under Mr. Sheldon Bissell and was intended to act as a reward for those persons reporting impaired drivers, and; WHEREAS, the DUIRR Program has not been in operation for a number of years and was not successful in having the desired effect of rewarding the reporting of impaired drivers and has placed an unnecessary workload and responsibility onto the Calaveras County Sheriff's Office and Auditors Office to maintain a program and associated designated fund that is neither active, efficient, affective and useful. WHEREAS, the Board of Supervisors finds that a donation of funds designated and held to fund the DUIRR Program in Account No. 55260000 to the Calaveras Community Foundation to support programs designed to mitigate and reduce the frequency of driving under the influence of drugs and alcohol results in a benefit to the public’s health and safety; NOW THEREFORE BE IT RESOLVED, by the Calaveras County Board of Supervisors that:

  1. Resolution 2013-072 is hereby rescinded.
  2. The Calaveras County Board of Supervisors directs that all fines, fees, and increased bail amounts as a result of Resolution No. 2013-072 shall be terminated effective May 1, 2022 and the Calaveras County Superior Court shall be notified to remove the increase in fines and fees implemented pursuant to Resolution 2013-072.
  3. Fines and fees collected pursuant to the DUIRR program, and which are kept in the Calaveras County designated DUIRR fund (Account No. 55260000), shall be donated to the Calaveras Community Foundation for the purpose of supporting programs designed to mitigate diminish the risks and frequency of driving under the influence of alcohol and drugs; the Board of Supervisors finds that such a donation results in a benefit to the public’s health and safety. Be it Further Resolved that;
  4. The Calaveras County Board of Supervisors authorizes and approves the Calaveras County Auditor to execute a check made payable to the Calaveras Community
