CIVIL and FAMILY LAW EX PARTE INFORMATION CASE NUMBER: (Local Rule 1.15)

Your request for an Ex Parte/Emergency Order has been set for review by the judge on:

(clerk will complete): Monday / Tuesday / Wednesday / Thursday / Friday: __________________________

GIVING NOTICE. A party seeking ex parte orders must give copies of all documents, (including this form, the filed petition or application, all declarations, attachments, and other documents that you want the judge to review) to all parties or attorneys no later than 10:00 a.m. one court day before the ex parte request is to be reviewed by the judge. Notice and delivery must be in-person, by phone, or by text message, e-mail, or other form of electronic communication. The notice must include a clear photo of the papers served. • GIVING NOTICE (aka: SERVICE). The person filing the ex parte request can give notice themselves or can have someone who is at least 18 years old, and not a party to the case, give notice. The person who gives notice must complete either: o Local form MMC-121 Declaration re: Notice upon Ex Parte Application for Orders for restraining orders -or- o Judicial Council form FL-303, Declaration Regarding Notice and Service of Request for Temporary Emergency (Ex Parte) Orders for other Family Law emergency requests. If giving notice would cause immediate damage requiring judicial intervention, or if giving notice is truly impossible, on the MMC-121 form you must explain in detail what emergency facts demonstrate the reason for not giving notice. The judge may still decide that notice is required or may deny your request for lack of notice. • FILING. All ex parte request paperwork, including the MMC-121 or FL-303 form must be filed with the Clerk’s Office no later than 11:00 a.m. the day the ex parte request is scheduled to be reviewed by the judge.

The facts stated in the ex parte request must be based on the personal observations of the person who signs the request. Except in limited circumstances, the judge cannot consider a statement by a witness or victim unless that person makes their statement in a written declaration that is signed under penalty of perjury. For temporary restraining orders only: (civil harassment/domestic violence/elder abuse/workplace violence): Documents may be filed in person or by e-filing. If the documents are e-filed, you must already have the date for ex parte judicial review scheduled by the Clerk’s Office at either the Ukiah Courthouse or the Ten Mile Branch Court in Fort Bragg. For all other ex parte requests: All documents must be filed in person at the Clerk’s Office at either the Ukiah Courthouse or the Ten Mile Branch Court in Fort Bragg. DO NOT email nor e-file the paperwork.

• JUDGE’S RULING. The judge will review the documents submitted and issue a ruling by 1:30 p.m. on the day of review. If the judge needs more information, a clerk will contact the parties by e-mail (preferred) or by phone, to tell them when they must appear in court.

Opposition. If the other party wants to oppose the request, they must file their opposition by 11:00 a.m. on the day of judicial review. Opposition to a request for a temporary restraining order (civil harassment/domestic violence/elder abuse/workplace violence) may be filed in person; or by e-filing; or by e-mail to exparte@mendocino.courts.ca.gov. Opposition to all other ex parte requests must be filed in person at the Clerk’s Office at either the Ukiah Courthouse or the Ten Mile Branch Court in Fort Bragg.
