10 PLAN OF OPERATION IN ABSENCE OF APPROPRIATION 11 ______________________________________/ 12 GENERAL ORDER 28 13 _________________

14 The Court adopts the following plan for operating in the absence of an appropriation or

15 continuing resolution. Essential bankruptcy activities will continue. The activities set forth in this

16 plan, and the employees who perform them, are essential.

17 Essential work includes:

18 (1) Activities necessary to support the exercise of judicial power, i.e., the resolution

19 of cases in which there is a constitutional or statutory grant of jurisdiction;

20 (2) Emergency activities necessary for the safety of human life and the protection of

21 property; and

22 (3) Activities otherwise authorized by law, either expressly or by necessary

23 implication, including:

24 (a) Items guaranteed by the Constitution;

25 (b) Activities funded with no-year appropriations;

26 (c) Entitlement programs; and

1 (d) Minimal activities needed for an orderly shutdown of other official functions.

3 The Court will continue to hear and decide cases, process bankruptcy cases and adversary

4 proceedings; and issue and enforce judgments. Judges will continue to work full-time. Each judge's

5 chambers staff, i.e. law clerks and judicial assistants, are essential to the resolution of cases. Clerk's

6 office staff has previously been reduced by budget cuts and sequestration to employees necessary to

7 the resolution of cases. Accordingly, all Clerk's office employees are essential. Essential employees

8 must report to their assigned duty stations. Travel that is not necessary for case resolution will not be

9 undertaken, unless approved by the Chief Judge.

10 This order shall remain in effect until further notice.
