This is the initial hearing on a petition to issue letters of administration for an intestate estate. The petition identifies three likely intestate heirs: the petitioner, and two apparent siblings. The Notice of Hearing only includes one of those siblings, which begs the question whether Lenee was given notice. There are also two different addresses provided for Jacon, which makes notice unclear. Moreover, the fact that petitioner is offering to provide a bond for a modest intestate estate to be split amongst siblings raises some question as to why the siblings did not agree to waive bond to avoid that expense. Petitioner does not have nominations from her siblings, and while she is not required to have those, the absence of a nomination or bond waiver raises the specter of conflict.

Petitioner to advise.

This is the initial hearing on a petition to admit decedent’s lost will to probate, and to appoint her

nominee to serve as executor thereof. This Court makes the following general observations:

1. Given that the proposed will includes an express bond waiver for this particular nominee,
this Court does not foresee exercising its discretion under §8571 to require a bond just
because the nominee is a non-residence of the State of California. Some basis for
believing a bond is needed would necessitate that kind of discretionary exercise.

2. Since petitioner apparently intends to serve as both executor and successor trustor,
§1208(b) requires notice to “each person to whom income or principal would be required or
authorized in the trustee's discretion to be currently distributed if the trust were in effect.”
Petitioner did not attach a copy of the trust instrument, and did not provide a declaration
stating the list of persons in the trust entitled to a distribution. As such, this Court is not in
a position to determine whether adequate notice has been given.

3. Regarding the will itself, it may generally be proven in the same manner and at the same
quantum of proof as any other will, with the exception of an adverse presumption that it
was revoked (see §§ 6124, 8223). Court will need subscribing witness attestations
(§8200), a declaration from someone with personal knowledge that the photocopy
accurately represents the terms set forth in the original (Lauermann v. Superior Court
(2005) 127 Cal.App.4th 1327), and a statement from someone with personal knowledge
explaining the diligent search performed, where decedent kept important documents, and
denial of presumed destruction. See §6120(b) and Estate of Trikha (2013) 219
Cal.App.4th 791. Since it appears that distribution out of the trust differs from intestacy,
this Court must permit sufficient time for those presumably aggrieved to be heard. If there
is a challenge to the lost will, current counsel may need to withdraw. See CPRC 3.7.

This is a continued review hearing regarding the overdue I&A for this estate. While the petition indicates (at Para 3.d.) close to $300,000 in assets, petitioner informs this Court that the estate consists mostly of personal memorabilia. No appearance is necessary. The Court, having received and reviewed petitioner’s TUO-PR-125, intends to find by a preponderance of the evidence that good cause exists to extend the period of administration for this estate in order to liquidate the anchor asset and remove the current squatter.

A §12200 review hearing will be set for 05/15/2026 at 8:30 a.m.

Petitioner is directed to give notice to her co-heir that failure to cooperate with petitioner’s efforts to safeguard assets may result in a surcharge against the heir’s interest (see §§ 9613, 9657, 9820(a).

This matter was erroneously scheduled for 8:30, but should be heard at 10:00 with the other cases handled by the court investigator. This is the initial hearing on a petition filed by the maternal grandparents to establish a guardianship over one child age 8. This is the natural sibling of the ward presently under guardianship with the same petitioners in PR11794.

Petitioner do not have consent from the bio parents. However, based on the factual summary

provided, immediate intervention is warranted. Per Probate §1513(b): “If the proposed ward is or may be [at risk], the court may refer the matter, in writing, to the local child welfare agency to initiate an investigation pursuant to W&I Code §329. The referral shall include a summary of the reasons for the referral and may include a copy of the petition under Section 1510, the investigator's report filed pursuant to subdivision (a), and any other material information. The probate court shall not hear and determine the petition to appoint a guardian of the minor until the child welfare agency has completed its investigation and has submitted the report to the probate court; [however], the probate court may take any reasonable steps it deems appropriate to protect the child's safety, including, but not limited to, appointing a temporary guardian.”

Petitioner to be informed regarding Family Code §3041: “Before making an order granting custody to a person other than a parent, over the objection of a parent, the court shall make a finding that granting custody to a parent would be detrimental to the child and that granting custody to the nonparent is required to serve the best interest of the child. A finding that parental custody would be detrimental to the child shall be supported by clear and convincing evidence.”

This is the initial hearing on a petition to secure letters of administration for a testate estate (aka, will annexed). Based on the petition, decedent directed in a written instrument that the entirely of his estate (estimated to be around $300,000) go “to Valerie Robbin of Coral Gables, Florida, or to her issue by right of representation” – except for a photo album which decedent devised directly to his brother Paul Sample. It is not clear why the petition states that decedent had no next of kin (Para 6.h.) when the will itself states otherwise. Either way, because the will is not self-proving (and in fact is not claimed to be), a DE-131 from a subscribing witness will be required. Notice must be provided directly to decedent’s brother. See §8110(a) and (b). Since the representation that decedent had no heirs appears to be false, this Court will not appoint petitioner or admit the will without identification of all heirs at law and notice to all.

This is continued hearing on a highly-contested guardianship case. On the docket this day are:

  1. Appointment of minor’s counsel. Parties were directed to file FL-150s by mid-January to permit this Court to assess options for covering the cost of minor’s counsel (see §1470). Nothing has been filed, though parties made representation that conditions set forth in Appendix E were met.

  2. Appointment of supervisor for mother’s visits. Parties were unable to agree on a supervisor. Since the hearing, only MGF Eric has filed FL-324(NP), signifying his willingness to serve.

  3. Although parties resolved DVROs with SPCOs, Calaveras made a CACI report against Mother, which impacts Mother’s custodial rights either way.

This was a “placeholder” petition to establish a guardianship while the parents were incarcerated. Mother has since been released and moved with the child out of county Father remains incarcerated through July. Father was advised to commence his own parentage petition, which he did on 02/03/2026 (see FL19378).

There is no POS on mother in either the guardianship or the new parentage action, and no future date set in the parentage action. It seems likely that the guardianship case can be put to rest and the focus now placed within the family case (where the petitioners can seek grandparent visitation rights).

Petition Hearing

Appoint Guardian - Amended Petition Filed?

01/23/2026 Petition File Tracking

This is the second hearing on a petition to establish a guardianship over one child who presently resides part-time with great grandfather, and part-time with uncle/aunt who have separately sought guardianship.

The child appears to be a member of a federally-recognized tribe, triggered ICWA protections. Bio father is unknown. Mother is incarcerated (see CRF78377). There is a CPO issued against mother protecting great grand-father and child. There is also a partial DV-TRO issued in FL19372 barring mother from having any contact with great grandfather and child, but it only includes a “stay away” from the GGF and not the proposed ward.

If inquiry results in a reason to know the child is an Indian child, then the formal notice

requirements of W&I Code §224.3 apply. See In re D.S. (2020) 46 Cal.App.5th 1041, 1052. Before appointing a temporary guardian of the person for an Indian child over the objection of a parent, tribe, or Indian custodian, the court must: (1) advise the parent or Indian custodian that if they cannot afford counsel, the court will appoint counsel for them under section 1912(b) of the Indian Child Welfare Act; and (2) find, in addition to facts in the petition establishing good cause for the appointment and any other showing the court may require under Probate Code section 2250(b), that the appointment is necessary to prevent imminent physical damage or harm to the child.

Uncle/aunt were supposed to secure bio mom’s consent by visiting her in jail, but the court file does not include the consent.
