1 2 3 4 5 6 UNITED STATES BANKRUPTCY COURT 7 FOR THE NORTHERN DISTRICT OF CALIFORNIA 8 9 In re 10 PLAN OF OPERATION IN ABSENCE OF APPROPRIATION 11 12 13 14 GENERAL ORDER 36 15 16 The Court adopts the following plan for operating in the absence of an 17 appropriation or continuing resolution. Essential bankruptcy activities will continue. The 18 activities set forth in this plan, and the employees who perform them, are essential. 19 Essential work includes: 20 (1) Activities necessary to support the exercise of judicial power, i.e., 21 the resolution of cases in which there is a constitutional or statutory 22 grant of jurisdiction; 23 (2) Emergency activities necessary for the safety of human life and the 24 protection of property; and 25 (3) Activities otherwise authorized by law, either expressly or by 26 necessary implication, including 27 (a) Items guaranteed by the Constitution; 28 (b) Activities funded with no-year appropriations;

1 (c) Entitlement programs; and 2 (d) Minimal activities needed for an orderly shutdown of other 3 official functions. 4 5 The Court will continue to hear and decide cases, process bankruptcy cases and 6 adversary proceedings, and issue and enforce judgments. Judges will continue to work 7 full-time. Each judge's chambers staff, i.e. law clerks and judicial assistants, are essential 8 to the resolution of cases. Clerk's office staff is already at the minimum staffing level 9 necessary to the resolution of cases. Accordingly, all Clerk's office employees are 10 essential. Essential employees must report to their assigned duty stations. Travel that is 11 not necessary for case resolution will not be undertaken, unless approved by the Chief 12 Judge.
