§ 9.04.010. Discharge of firearms prohibited—Exceptions.

A. Discharge of Firearms. It is unlawful for any person to discharge any firearm within the limits of the city.

B. Exceptions. The prohibitions of this section shall not apply to the following:

  1. Any peace officer acting in the official line of duty; or

  2. Any person when necessary to protect human life or destroy or kill any predatory or dangerous animal while defending one's self or another person against immediate threat of great bodily harm; or

  3. The discharge of any target trap in the limits of a target range, skeet range, or shooting area which has been inspected by the sheriff and approved, in writing, by the sheriff and permitted by the city; or

  4. The discharge of blank cartridges in theatrical performances or for sporting events; or

  5. The firing of salutes by firing squads for ceremonial occasions or military funerals; or

  6. Stud guns.

§ 9.04.020. Firearms defined.

For the purpose of this chapter the term "firearm" means any gun, pistol, revolver, rifle and any other instrument which expels a metallic object such as, but not limited to, a bullet, through the force of gunpowder or explosive.

§ 9.04.030. Discharge by minors.

Any discharge of a firearm by a minor is prohibited within the limits of the city, except as permitted by Section 9.04.010(B); provided that, no minor shall discharge a firearm under subsection (B)(3), (B)(4) or (B)(5) of Section 9.04.010 unless he or she is supervised by, and in the presence of, an adult. No adult need be present if the discharge is allowed under Section 9.04.010(B)(2).

§ 9.04.040. Violation—Penalty.

Violation of any provision of this chapter shall be a misdemeanor.
