§ 13.24.010. Adoption of Well Standards.¶
The City Council hereby adopts the State of California Water Resources Control Board ("SWRCB") Model Well Standards Ordinance adopted in accordance with Water Code Section 13801 published November 1, 1989, a copy of which is attached hereto and made a part hereof, and all amendments, revisions, and additions thereto which may be made from time to time by SWRCB.
§ 13.24.020. Enforcement Authority.¶
The City Council hereby designates the Blue Lake Public Works Department as the enforcement agency to administer and enforce this chapter.
§ 13.24.030. Permit.¶
A permit issued pursuant to this chapter must comply with all other applicable provisions of law and shall expire six months from the date of issuance unless it is extended by the enforcement agency.
§ 13.24.040. Deposit.¶
Prior to the issuance of a permit or any extension thereof, the applicant may be required to post with the enforcement agency a cash deposit or bond to guarantee compliance with the provisions of this chapter and the applicable permit, such cash or bond to be in an amount deemed necessary by the enforcement agency to remedy improper work, but not in excess of the total estimated cost of the permitted work.
§ 13.24.050. Fees.¶
The City Council may by resolution establish fees for the processing of any application for a permit, extension of permit, or certificate of exemption pursuant to this chapter. The payment of such fee, if any, established by such resolution shall accompany the application to which it pertains. If the application is withdrawn before the issuance of the permit, the enforcement agency shall compute the cost to the City of processing the application up to that point in accordance with the City's standard cost accounting procedures and, if the cost is less than the amount of the fee paid, the difference shall be refunded to the applicant.
§ 13.24.060. Violation and Penalty.¶
Any person who violates any provision of this chapter shall be guilty of a misdemeanor/infraction, and shall be guilty of a separate offense for each and every day or portion thereof during which such violation is committed, continued, or permitted, and shall be subject to the same punishment provided by the California Penal Code for each such separate offense as for the original offense. The provisions of this section are in addition to and independent of any other sanctions which are or may be imposed under this chapter or any other provision of law.
