8.36.010 - Purpose.

The purpose of this chapter is to assure that the water furnished or supplied by the domestic water supply systems under the jurisdiction of the city shall at all times be pure, wholesome, potable, healthful and in adequate supply.

8.36.020 - Division of responsibilities and scope.

The department of environmental health services shall have the responsibility to monitor and enforce all applicable laws and orders for domestic water supply systems with less than two hundred service connections.

8.36.030 - Standards.

Minimum standards for the design, construction, operation, maintenance, repair and monitoring for domestic water systems requiring a permit by this chapter shall also include those standards in the California Health and Safety Code, Division 5, Part 1, Chapter 7, Water and Water Systems; and California Administrative Code, Title 17, Part 1, Chapter 5, Subchapter 1:

A. Water Quality Monitoring, Sections 7001 through 7025;

B. Water Quality Standards, Sections 7001 through 7025;

C. Waterworks standards, Sections 7050 through 7081;

D. Cross-Connection Control, Sections 7583 through 7622;

E. Operator Certification, Sections 7100 through 7134.

8.36.040 - Permits.

No person shall furnish or supply water to a user for domestic purposes from any source of water supply unless he first files a written application to do so with the department and receives and possesses a valid permit as provided herein.

A. Conditions of Approval. Permits shall be issued subject to compliance with the standards provided in this chapter and with the submission and subsequent approval by the department of plans demonstrating compliance with these standards, except where such standards shall be inapplicable or modified as expressly provided for in this division. Permits may also include any other condition or requirement found by the department to be necessary to accomplish the purpose of this division.

B. Temporary Permit. The department may, for good cause, grant a temporary permit to any person who has filed an application for a permit as provided herein upon such terms as it shall determine are in the public interest pending completion of the investigation required by Section 8.32.020.

C. Denial. If, upon the completion of the investigation, the department determines, as a fact, that the water furnished or supplied or proposed to be supplied is such that under any circumstances and conditions it is impure, unwholesome, unpotable or may constitute a menace or danger to health or lives of human beings, or the existing or proposed source facility or distribution system is unhealthful or insanitary or not suited to the production and delivery of pure, wholesome, potable and healthful water at all times, it shall deny the application and order the applicant to make such changes as it deems necessary to secure a continuous supply of pure, wholesome, potable and healthful water.

D. Revocation. Any permit issued may be revoked or suspended by the department at any time if it determines that the water being supplied or furnished by the permittee is or will become impure, unwholesome, unpotable or endanger the lives or health of human beings.

E. Exception. This chapter shall not apply to a domestic water supply system with two to four service connections except in specific areas in which the department has found its application to be necessary for the protection of public health and has given written notice thereof to the person furnishing or supplying water in such area. The department may prescribe action to be taken by such persons or users to insure that their domestic water will not be injurious to health.

8.36.050 - Modifications—Notification and approval required.

No person shall modify, add to or change his source facilities or distribution system until he notifies the department, submits information required by the department, and then receives approval from the director authorizing such modifications, additions or changes.

8.36.060 - Monitoring.

Any person who furnishes or supplies water to a user for domestic purposes shall provide at such persons expense analyses of such water to the department as per California Administrative Code, Title 17, Domestic Water Supplies Quality and Monitoring.

8.36.070 - Water quality standards.

All water sources used for domestic water supply shall meet the minimum standard in California Administrative Code, Title 17, Domestic Water Supplies Quality and Monitoring.

8.36.080 - Water quality, source and storage requirements.

The quantity of water available from all water sources and distribution storage reservoirs shall be as per Table I and Table II of this section.

8.36.090 - Required separation between water mains and sanitary sewers.

Underground street utility location for water and sewer mains shall conform to the standards contained in the current city road department publication entitled Standard Specifications, Drawings 310 and 311, and the state of California, State Department of Health bulletin entitled Required Separation Between Water Mains and Sanitary Sewers.

8.36.100 - Backflow and cross-connection control.

Every person furnishing or supplying water to users shall, by approved methods, prevent water from unapproved sources or any other substances from entering the domestic water system, and shall conform to the standards of California Administrative Code, Title 17, Cross-Connection Control.

8.36.110 - Treatment requirements.

Treatment facilities and operation shall be provided as required by the department on a case-by-case basis. Treatment of all surface waters shall be provided and shall include, but not be limited to, reliable disinfection.

8.36.120 - Correction of sanitary defects and health hazards.

The department may order such repairs, alterations or additions to the proposed or existing source facilities and distribution system as will insure that the water furnished or supplied shall at all times be in continuous supply, pure, wholesome, potable and healthful, without danger to the health of human beings.
