§ 13.16.010 IMPROVEMENT DEFINED.¶
The term IMPROVEMENT as used in this chapter shall include the grading or regrading, the surfacing or resufacing of any street, or the construc-tion or reconstruction in any streets or sidewalks, crosswalks, driveways, curbs or gutters.

§ 13.16.020 PERMIT REQUIRED.¶
It shall be unlawful for any person, as principal or agent, to make any improvement as defined above in § 13.16.010 by or under private contract without first obtaining a permit to do so from the Director of Public Works. Any such permit so granted by the Director of Public Works shall be subject to the terms and conditions of this chapter and shall not be transferable.

§ 13.16.030 FEES.¶
(A) Before issuing such permit the Director of Public Works shall require:
(1) Payment of a nonreturnable permit fee, and
(2) Payment of a nonreturnable observation fee.
The amounts of such fees shall be set by resolution of the City Council.
(B) The purpose of the observation fee is to defray the expenses incurred by the city in connection with the improvement for, but not limited to, inspecting, supervising, completing, cleaning up and/or making safe the work.

§ 13.16.040 WAIVER OF PERMIT FEE.¶
Whenever the owner of property abutting side-walks is required to repair these sidewalks under the provisions of Cal. Sts. & High. Code Chapter 22, Part III, Division 7, the permit fee required by this chapter shall be waived. However, the property owner shall make application and receive a permit to do the work and have the work inspected in accordance with the provisions of this chapter.

§ 13.16.050 DIRECTING IMPROVEMENT.¶
The improvement shall be made under the direction and to the satisfaction of the Director of Public Works and all work shall, during the progress and on its completion, conform to the lines and levels which may from time to time be given by the Director of Public Works.

§ 13.16.070 NOTICE PRIOR TO COMMENCEMENT OF WORK.¶
The Director of Public Works shall be given at least 24 hours' notice in writing of the time of commencement of the work of making any improve-ments in order that he may procure and assign an inspector to inspect the same; and in case the services of the Director of Public Works are required for laying out any portion of the work, 24 hours' notice shall be given the Director of Public Works of the time when such services shall be required. Such work shall not be commenced until after notice has been given and the necessary engineering work completed.

§ 13.16.080 RECORD OF EXPENSES.¶
It shall be the duty of the Director of Public Works to cause to be kept a just and true account of all expenses incurred by his department in connection with improvements.

§ 13.16.090 INSPECTION AND SUPERVISION.¶
It shall be the duty of the Director of Public Works to cause such improvements made by or under a private contract to be duly inspected and supervised during the progress of the work thereupon, to cause to be kept a just and true account of the cost of inspection and supervision of such improvement, and otherwise to carry out the provisions of this chapter.
