Mitigation monitoring program (MMRP)

The tracking program (Pub. Res. Code § 21081.6) an agency must adopt with any mitigated approval — who verifies each measure, when, and how.

Definition

The mitigation monitoring and reporting program is the compliance-tracking framework the CEQA statute (§ 21081.6) requires whenever an agency approves a project with mitigation — under an EIR or a mitigated negative declaration. Adopted alongside the findings, it is in practice a table mapping each measure to a responsible party, a timing trigger (grading permit, plan check, certificate of occupancy), and a verification method. The program runs with the entitlement and binds successors in interest.

Why it matters in an underwrite

The MMRP is where CEQA costs outlast entitlement: measures resurface as plan-check holds, pre-construction survey seasons, third-party monitors, and reporting fees — schedule items that belong in the construction budget, not just the legal one. Lenders' conditions lists mirror the MMRP, and non-compliance risks stop-work orders and enforcement, so assign an owner for it on day one of construction.
