Definition
The U.S. Department of Housing and Urban Development is the cabinet agency behind most federal housing money. Its Office of Multifamily Housing administers project-based Section 8 under 42 U.S.C. § 1437f and runs FHA mortgage insurance for apartment loans; the Office of Public and Indian Housing funds housing authorities and the voucher programs; Community Planning and Development runs the HOME, Housing Trust Fund and CDBG block grants.
HUD also writes the cross-program rulebook — income, asset and property standards live in 24 C.F.R. Part 5 — and its Office of Fair Housing and Equal Opportunity enforces the Fair Housing Act against public and private housing providers alike.
Why it matters in an underwrite
A layered affordable deal answers to several HUD offices at once — a 4% bond deal with project-based vouchers, HOME soft debt and a 221(d)(4) mortgage reports to PIH, CPD and Multifamily under three different CFR parts, each with its own rents, inspections and reviews. Underwriting federal money starts with mapping which HUD office, regulation and handbook governs each layer, because the rules do not defer to each other: the most restrictive requirement wins, unit by unit.
